As required by California law, anyone who drives must have auto insurance and proof thereof. Yet, an overwhelming number of individuals choose to drive without enough insurance or without insurance at all. In addition to these drivers, there are those who try to scam the system by committing insurance fraud. All of this adds up to higher premiums for responsible, law-abiding citizens who follow proper insurance guidelines.
In a recent one week sweep by detectives of the California Dept. of Insurance assisted by law enforcement in 22 California counties, more than 200 felony counts and multiple misdemeanors were filed for over 195 people for alleged auto insurance fraud against 40 insurance companies. In almost all of the cases, the drivers were either underinsured or uninsured when accidents occurred. Then they allegedly purchased or added coverage following the accident so that claims could be filed for the damage repair, when in fact no coverage was in place when the accident occurred. The reason we point out this rampant type of fraud occurring in California is to remind you of how often this occurs.
In order to protect yourself, whenever you are involved in an auto accident, we strongly recommend the following: take detailed notes and records of the incident, including pictures of the involved vehicles at point of impact and the damage to each, and get the names, contact info and insurance information of all involved parties and witnesses. Additionally, calling the police and having an official police report filed can ensure further accuracy of the incident. Most importantly, do not admit guilt and do not get involved with possible payment at the scene to cover damage.
